These Terms and Conditions (the “Terms”) govern access to and use of the website and services available at https://kuki-kuki.com (the “Service”). Please read these Terms carefully.

2. Acceptance; Scope
2.1 Acceptance. By accessing, browsing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2.2 Parent Consent. Where the Service is used by or for a child, the Parent/Guardian registering the child must also accept the Parent/Guardian Consent & Child Account Authorization presented during registration (the “Parent Consent”), which is incorporated by reference into these Terms.
2.3 Capacity. You represent and warrant that you have the legal capacity and authority to enter into these Terms. If you act on behalf of a minor as Parent/Guardian, you represent and warrant that you hold parental responsibility or legal guardianship and that you are authorised to provide the consents and permissions required for the minor to use the Service.
3. Definitions
For the purposes of these Terms:
- “Service” means https://kuki-kuki.com and any related pages, functionalities, and services made available by us.
- “Parent/Guardian” means an individual with parental responsibility or legal guardianship for a child.
- “Child” or “Minor” means any user under eighteen (18) years of age.
- “Account Owner” means the Parent/Guardian who creates and controls the Child’s account.
- “Parent Wallet” means the stored-value account held in the Parent/Guardian’s name on the Service.
- “Child Wallet” means the stored-value account held in the Child’s name on the Service.
- “Wallet Credits” means stored-value balances held in a Parent Wallet or Child Wallet, denominated in currency.

- “GDPR”: Regulation (EU) 2016/679.
- “DSA”: Regulation (EU) 2022/2065 (Digital Services Act).
- “UK GDPR” and “DPA 2018”: the UK data protection framework including the Data Protection Act 2018.
- “UK Children’s Code”: the ICO Age Appropriate Design Code for online services likely to be accessed by children.
- “COPPA”: the U.S. Children’s Online Privacy Protection Act and COPPA Rule (16 C.F.R. Part 312).
- “UK OSA”: the UK Online Safety Act 2023.
- “ePrivacy / Cookies”: the EU ePrivacy framework and (in the UK) PECR rules for cookies and similar technologies.
4. Eligibility; Child Accounts
4.1 Parent-Only Registration (Ages 6-17). The Service is intended for children aged six (6) through seventeen (17) years, exclusively through parent-managed accounts. All children must be registered by a Parent/Guardian. Children may not create accounts independently.
4.2 No Social or Community Features. The Service does not provide chat, community spaces, user-to-user messaging, public profiles, or functionality enabling users to publish content for other users to view.
4.3 Age Information and Safeguards. We may request age (or age-band) information and apply proportionate safeguards in order to provide appropriate protections for minors and to operate the Service in accordance with privacy-by-default and child-safety expectations.
4.4 No Advertising. We do not serve advertisements on the Service, including targeted advertising, whether to children or to parents.
5. Service Description; Educational Nature
5.1 Extracurricular Enrichment. Kuki-Kuki provides extracurricular educational content and activities for children, including video and/or audio lessons and learning progress tracking (the “Educational Services”).
5.2 Not an Accredited Educational Institution. The Service is provided as supplementary enrichment and is not an accredited school or educational institution, does not issue state-recognised diplomas, and does not replace compulsory education or any formal schooling obligations that may apply in a user’s jurisdiction.
6. Account Security; Parental Responsibilities
6.1 Credential Security. The Account Owner is responsible for maintaining the confidentiality of login credentials and for all activities occurring under the account.
6.2 Supervision. The Account Owner is responsible for supervising the Child’s use of the Service and ensuring that such use complies with these Terms and applicable law.
6.3 Unauthorized Access. If you suspect unauthorised access or a security incident relating to your account, you must notify us promptly at info@smarthealthandscience.nl.
7. Acceptable Use
You shall not, and shall not permit any Child to:
(a) use the Service for any unlawful purpose or in any manner that endangers minors;
(b) attempt to bypass, disable, or otherwise interfere with access controls, security measures, or parental controls;
(c) introduce malware or other harmful code, scrape or harvest data from the Service, or interfere with the integrity or performance of the Service;
(d) impersonate any person or entity, misrepresent identity, or provide false parental authorisation or other false information.
We may take proportionate enforcement action, including suspension or termination, in response to violations.
8. Intellectual Property; Content
8.1 Our Content. All educational content, videos, audio, designs, text, software, and other materials made available through the Service (collectively, “Content”) are owned by Smart Health and Science ZZP or our licensors and are protected by intellectual property laws. Except as expressly permitted by these Terms, no rights are granted to you.
8.2 No User-Generated Content Publication. The Service does not publish user-generated content. Any inputs provided by a Child during learning activities (e.g., quiz responses) are used solely to operate the learning experience and are not displayed to other users.
8.3 Feedback. If you provide suggestions, feedback, or ideas, you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, and implement such feedback for the purpose of improving the Service, without compensation and without any obligation to you.
9. Privacy; Data Protection; Cookies
9.1 Privacy Notice. Our processing of personal data is described in our Privacy Notice.
9.2 Children’s Data Protections. We apply child-appropriate safeguards and privacy-by-default principles consistent with the nature of the Service and, where relevant, the UK Children’s Code.
9.3 COPPA (U.S., Under 13). Where COPPA applies, we provide direct notice to parents and obtain verifiable parental consent before collecting, using, or disclosing personal information from children, subject to legally permitted exceptions.
9.4 Cookies and Similar Technologies. We use cookies and similar technologies. Where required by applicable law (including EU ePrivacy and UK PECR), we will not set non-essential cookies unless and until you provide consent, and you will be able to manage and change your preferences.
10. Prepaid Wallet, Deposits, and Withdrawals
10.1 Prepaid Wallet. The Service uses a prepaid wallet model. The Parent/Guardian may, on a voluntary basis, deposit funds into a Parent Wallet held on the Service in their name. Wallet Credits represent only the stored-value balance held on the Service; they are not money, not electronic money, not a payment account, not a deposit-taking account, and not a financial instrument, and we do not pay interest on them.
10.2 No Subscription; No Recurring Charges. There is no subscription, no recurring billing, no auto-renewal, and no fixed term associated with use of the Service. The Parent/Guardian is charged only for deposits the Parent/Guardian affirmatively initiates.
10.3 No Charge for Course Access. Course access is provided without per-course charges. Assigning a course to a Child does not debit the Parent Wallet, and we do not sell individual courses, lessons, or learning content.
10.4 Funding of Rewards. Wallet Credits in the Parent Wallet fund Rewards earned by the Child through educational activity, as set out in the Rewards Policy. When the Child completes qualifying activity, configured Reward amounts are transferred from the Parent Wallet to the Child Wallet and become available to the Child for redemption under the Rewards Policy.
10.5 Withdrawals. The Parent/Guardian may request withdrawal of unallocated Parent Wallet balance, subject to verification, fraud-prevention checks, and any payout method or fees disclosed at the time of withdrawal. Amounts already transferred to the Child Wallet, or already redeemed by the Child, are not available for withdrawal by the Parent/Guardian.
10.6 Fees and Taxes. Deposit, withdrawal, redemption, currency-conversion, and payment-processor fees, if any, will be disclosed at the relevant transaction step. Taxes may apply depending on your location and are your responsibility unless we are required by law to collect them.
10.7 Refunds; Statutory Rights. Except where mandatory consumer-protection laws require otherwise, Wallet Credits already transferred from the Parent Wallet to the Child Wallet, and amounts already redeemed by the Child, are non-refundable. Mandatory cooling-off periods or other statutory consumer rights that apply to you are not affected by these Terms.
11. Rewards and Gift Cards (Non-Cash; Not Financial Services)
Where the Service includes rewards (including digital gift cards), the following terms apply:
11.1 Nature of Rewards. Rewards are promotional/loyalty-style benefits linked to educational participation and engagement.
11.2 Not Money; No Cash Value. Rewards — such as third-party digital gift cards or codes delivered to the Child — are not money, not electronic money, not a payment account or stored-value account held with us, and have no cash value as between you and us. Rewards are not redeemable for cash and cannot be exchanged for currency by us. Wallet Credits that fund Rewards are stored-value balances on the Service as described in Section 10 and are distinct from Rewards.
11.3 Policy and Limits. Eligibility rules, limits, redemption conditions, and fraud-prevention measures are set out in the Rewards Policy, which is incorporated by reference.
12. Suspension; Termination
We may suspend, restrict, terminate, or refuse registration/access where reasonably necessary to:
(a) comply with applicable law or lawful requests;
(b) protect children’s safety or the security of the Service;
(c) prevent or address fraud, abuse, or misuse; or
(d) enforce these Terms, in a proportionate manner.
13. Disclaimers
13.1 As-Is; Availability. The Service is provided on an “as is” and “as available” basis and may contain errors, interruptions, or downtime.
13.2 No Guarantee of Outcomes. We do not warrant or guarantee any specific learning outcomes, performance improvements, or results.
13.3 Not Regulated Advice. The Service constitutes extracurricular educational enrichment and does not constitute regulated professional advice.
14. Limitation of Liability
To the maximum extent permitted by law:
(a) we shall not be liable for any indirect, incidental, special, consequential, or punitive damages; and
(b) nothing in these Terms excludes or limits liability to the extent such limitation is prohibited by applicable law (including mandatory consumer protections).
15. Governing Law; Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of The Netherlands. The competent courts in The Netherlands shall have exclusive jurisdiction, subject to any mandatory consumer protection rules that apply.
16. Changes to These Terms; Notice
16.1 Updates. We may amend these Terms from time to time to reflect changes in the Service, legal requirements, or security and operational needs.
16.2 Notice of Significant Changes (In-Service Notice). For significant changes, we will provide notice within the Service (for example, by a prominent banner or pop-up) and, where appropriate, require the Account Owner to actively accept the updated Terms at the next login or prior to continued use. An updated version will remain available on https://kuki-kuki.com with the “Last updated” date.
16.3 COPPA Material Changes. If we implement material changes to practices that a parent previously consented to under COPPA, we will provide direct notice to parents as required and obtain renewed verifiable parental consent where applicable.
17. UK Online Safety Act (OSA)
The UK Online Safety Act primarily imposes duties on regulated user-to-user services and regulated search services. As of the Effective Date, the Service does not provide user-to-user communication features or public content posting and is not operated as a regulated user-to-user or search service in the typical sense. If we introduce features enabling user interaction or user-posted content, we will reassess scope and implement appropriate risk assessments and safeguards.
